Service Terms
These are the terms for using the Hey Marge text-based office assistant service ("the Service"). By signing up, you ("the Client") agree to them.
1. What the Service does
Hey Marge is an AI assistant your business runs by text. It sends quotes, chases quotes that go quiet, sends 24h booking confirmations, sends invoices with a pay link, chases overdue invoices, and asks happy customers for a Google review, all in your business's own name, not ours. It does not replace your own judgement: Marge doesn't price a job you haven't told her the price for, doesn't act as a licensed tradesperson, and doesn't make promises on your behalf beyond what you've set up. You stay responsible for the actual work, for your pricing, and for checking what goes out under your name.
2. Month to month, no lock-in
This is a month-to-month service. There is no fixed-term contract. You can cancel at any time by texting or emailing us; cancelling takes effect at the end of your current billing month and you won't be charged again after that. We can also end the Service per clause 8 below. Fees already paid for the current billing month are not refunded for a mid-month cancellation, unless something's gone wrong on our end.
3. Fees
- First 30 days: free, no card needed, while we set your business up properly.
- Monthly fee after that: A$99 a month for the Marge plan, billed in advance on the same date each month as your sign-up. (Marge Plus and Marge Max are coming soon at different price points - we'll tell you the price before you'd ever be moved onto one.)
- Founding offer: the first 10 client businesses to sign up get 30% off that price for life, for as long as they stay a customer.
- Fees may change with at least 30 days' notice. You can cancel instead of accepting a change.
- You only need to arrange payment if you choose to keep going after the free trial - no card is held or charged during the 30 days.
4. Setup
We set your business up in Hey Marge, your branding, pricing style and message templates, typically in about 10 minutes. You review and approve your message templates before anything goes out to a real customer.
5. Accuracy, AI and your approval
Marge does her best to read your texts correctly and send accurate quotes and invoices, but she can make mistakes, especially with unusual job descriptions, names or shorthand. Where Marge uses AI to help read a tricky message, that's a tool to speed things up, not a guarantee - it can get things wrong, same as any assistant can.
That's why, by default, every quote, invoice and scheduled follow-up message is shown to you first and only sent once you reply to approve it ("safety mode"). You're responsible for checking what Marge drafts before it's sent, and for fixing anything wrong straight away. If you choose to switch safety mode off, messages can go out without that check, and more of that responsibility sits with you from that point on.
We are not liable for lost business, missed jobs, or any other loss arising from an inaccurate or incomplete message, except where that can't legally be excluded. Marge never gives trade advice and never invents a price you haven't given her - if she ever appears to do either, that's a bug, please tell us straight away.
6. Your responsibilities
- You confirm you have the right to text the customers and numbers you give us, and that you've told your customers they may receive automated texts about their quote, booking or invoice.
- Marketing-style messages (like review requests and yearly check-in reminders) need your customers' consent under the Spam Act - that responsibility sits with your business. Marge won't send marketing texts without recorded consent, as a safeguard built into the Service, but that's not a substitute for only ever adding customers you've genuinely dealt with.
- You're responsible for the accuracy of your business details fed into Marge (service area, hours, pricing wording, licence number).
- You're responsible for complying with your own trade licensing, insurance and consumer law obligations - the Service helps you run the admin side, it doesn't make you compliant with anything else.
7. Data and privacy
We handle customer details and message records as set out in our Privacy Policy. You agree to that policy as part of these terms, and you agree not to ask us to do anything with customer data that would breach the Privacy Act 1988 (Cth) or the Spam Act 2003 (Cth), for example, sending marketing texts to customers who haven't agreed to receive them or who've opted out.
8. Suspension and termination
We can suspend or end the Service if fees go unpaid after reasonable notice, if you ask us to do something unlawful with customer data, or if you breach these terms and don't fix it after being told. You can cancel any time per clause 2.
9. No guarantee of results
We don't guarantee a specific number of quotes sent, invoices paid, or reviews received. Results depend on your own job volume, your customers, and how you use the Service.
10. Limitation of liability
To the maximum extent the law allows, our total liability to you for anything arising out of or connected with the Service - whether in contract, negligence or otherwise - is limited to the fees you've paid us in the three months before the claim arose. We're not liable for indirect or consequential loss, such as lost profits, lost business opportunities or reputational damage. Nothing in these terms limits any liability that can't lawfully be excluded or limited, including under the Australian Consumer Law.
11. Changes to these terms
We may update these terms from time to time. We'll give you reasonable notice of material changes (e.g. by email) before they take effect.
12. Governing law
These terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of its courts.
